PetOS Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and SymbioAI OS LLC ("PetOS," "Company," "we," "us," or "our"). These Terms govern your access to and use of the PetOS mobile application, related APIs, public share pages, websites, and all associated products and services (collectively, the "Services").

BY CREATING AN ACCOUNT, DOWNLOADING THE APPLICATION, ACCESSING ANY SERVICE, OR CLICKING "I AGREE," YOU REPRESENT THAT: (I) YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE; (II) YOU HAVE THE LEGAL CAPACITY TO ENTER INTO A BINDING AGREEMENT; (III) YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS; AND (IV) YOU HAVE READ AND AGREE TO OUR PRIVACY POLICY (AVAILABLE AT Privacy Policy).

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES AND DELETE ANY INSTALLED APPLICATIONS.

1. Description Of Services

PetOS is a consumer-facing pet health decision-support platform. The Services include, without limitation:

(a) Symptom Triage And AI Chat — structured symptom assessment with plain-language guidance, urgency levels, and recommended next steps;
(b) Pet Health Profiles And Records — storage of pet demographics, vaccination history, medications, conditions, clinic visits, and uploaded documents;
(c) Daily Check-In And Pawsona Program — daily questions, streaks, lifestyle insights, and milestone personality cards;
(d) Care Plans And Monitoring — saved care guidance, follow-up schedules, and reminders;
(e) Veterinarian Search And Cost Tools — nearby clinic search (with your location permission) and illustrative cost estimates;
(f) Insurance Education — informational insurance comparisons and readiness tools (not binding quotes unless a separate consent flow is enabled);
(g) Share Links — optional public links for sanitized triage, care plan, or personality content;
(h) Paw Points — an internal earn-only engagement program with no monetary value in v1.0.

We may introduce additional features over time, including co-parent access, referrals, or in-app purchases. When we enable new features that materially affect these Terms, we will update these Terms and notify you as required by law.

2. Nature Of Services

THE SERVICES, INCLUDING ALL AI-GENERATED OUTPUTS, TRIAGE ASSESSMENTS, COST ESTIMATES, CARE PLANS, AND RECOMMENDATIONS, ARE INFORMATIONAL AND EDUCATIONAL IN NATURE. THE SERVICES DO NOT CONSTITUTE VETERINARY MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE SERVICES DO NOT ESTABLISH A VETERINARIAN-CLIENT-PATIENT RELATIONSHIP ("VCPR"). USE OF THE SERVICES IS NOT A SUBSTITUTE FOR PROFESSIONAL VETERINARY CARE. SEE SECTION 18 FOR ADDITIONAL CRITICAL DISCLAIMERS.

3. Account Registration And Security

To use certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

When you create pet profiles, you represent that you are the legal owner of the animal or have authority to provide information about the animal.

Notify us immediately at hello@symbioai.io if you suspect unauthorized access to your account.

You may delete your account at any time through in-app Settings. Upon deletion, we process removal of your data as described in our Privacy Policy.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent or abusive conduct, or misuse the Services.

4. License Grant And Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use in connection with animals you own or for which you are an authorized caretaker.

You agree not to:

(a) Copy, modify, reverse-engineer, decompile, or create derivative works based on the Services, triage logic, AI systems, or proprietary databases;
(b) Use the Services or outputs to build, train, or improve any AI, machine learning, or competing product without our written consent;
(c) Use automated means (bots, scrapers) to access or collect data from the Services;
(d) Interfere with the security, integrity, or availability of the Services;
(e) Misrepresent PetOS outputs as veterinary diagnoses or professional medical advice;
(f) Use AI outputs as the sole basis for euthanasia, emergency, surgical, or other irreversible decisions;
(g) Share public link content in a misleading way or attempt to re-identify users from shared content;
(h) Upload content you do not have the right to share, or content depicting animal abuse or neglect;
(i) Use the Services for any unlawful purpose.

5. User Content And Feedback

You retain ownership of content you submit ("User Content"), including pet photos, health records, chat messages, and documents. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display User Content solely to operate, maintain, secure, and improve the Services, comply with law, and enforce these Terms. This license does not permit use of your identifiable User Content for AI model training unless you provide separate opt-in consent as described in our Privacy Policy.

If you provide suggestions, bug reports, or feedback, you grant us the right to use that feedback without obligation or compensation to you.

6. Fees, Paw Points, And Future Purchases

PetOS v1.0 is free to use. Paw Points are an internal engagement metric with no cash value, are not transferable, and cannot be purchased in v1.0.

If we introduce paid features or in-app purchases in the future, they will be offered through the Apple App Store (or other disclosed payment processors), subject to applicable store terms. We will update these Terms before enabling any purchase flow. Billing questions: hello@symbioai.io.

7. Device Permissions

The PetOS application may request access to device features. By granting permission, you consent to the corresponding data practices described in our Privacy Policy:

(a) Location (When In Use) — nearby veterinarian search via Google Places;
(b) Camera — pet profile photos;
(c) Photo Library — selecting photos for profiles, chat, or support;
(d) Microphone And Speech Recognition — on-device speech-to-text for chat input; audio is not uploaded to our servers;
(e) Push Notifications — reminders, follow-ups, and service messages;
(f) Network Access — required for online functionality.

You may revoke permissions through device settings. Revocation may limit related features.

8. Artificial Intelligence And Machine Learning Terms

THE SERVICES USE ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING. YOU ACKNOWLEDGE AND AGREE THAT:

(a) AI outputs are probabilistic and may contain errors, omissions, or hallucinations;
(b) Clinical risk level is determined solely by PetOS's deterministic rule engine. Large language models generate explanations only and may not assign, modify, or override risk levels, recommended actions, or emergency safety overrides;
(c) AI outputs do not reflect the clinical judgment of a licensed veterinarian;
(d) AI outputs should never be used as the sole basis for medical decisions;
(e) Output quality depends on the accuracy and completeness of information you provide;
(f) THE SERVICES ARE NOT MEDICAL DEVICES AND HAVE NOT BEEN CLEARED OR APPROVED BY THE FDA, USDA, OR ANY REGULATORY BODY FOR USE AS DIAGNOSTIC TOOLS.

Chat image attachments are transmitted for session context but are not analyzed by computer vision models.

9. Privacy

Your privacy is important to us. Our Privacy Policy at Privacy Policy describes how we collect, use, and protect your information. By using the Services, you consent to those practices.

We do not sell personal information. We do not share pet health data with insurance partners without your explicit consent.

11. Insurance And Cost Information

Insurance and cost information in PetOS is informational only. Estimates are not quotes, guarantees, coverage determinations, claim decisions, or legal advice.

Insurance availability, premiums, exclusions, waiting periods, and reimbursement depend on the carrier, policy, location, pet profile, and other factors. Review carrier documents before purchasing insurance.

PetOS may earn a commission if you purchase insurance through a partner link. We rank plans based on fit, not commission. Sponsored or partner offers are labeled and must not be presented as neutral best plans solely because of compensation. See the in-app Commission Disclosure for details.

Insurance quote or partner sharing flows may be preview-only until an approved integration and consent flow are live.

12. Third-Party Services

The Services integrate with or link to third-party services including Apple (Sign in with Apple, APNs, Speech), Google (Cloud, Vertex AI, Places), Supabase, Resend, and external websites (veterinary clinics, insurance carriers). Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party practices.

13. Service Availability, Beta Features, And Changes

We may modify, suspend, or discontinue any part of the Services at any time. Features may be labeled beta, preview, or early access and are provided "as is" without warranties. Beta features may be unstable or less accurate and may change without notice.

Some features visible in the app may be disabled or gated until a future release. We will update these Terms when such features become generally available if they materially affect your rights.

14. Intellectual Property

All rights in the Services — including software, triage logic, rule engines, branding, design, and documentation — are owned by SymbioAI OS LLC or its licensors and are protected by intellectual property laws. These Terms do not grant you any ownership rights in the Services.

15. Indemnification

You agree to indemnify, defend, and hold harmless SymbioAI OS LLC and its officers, directors, employees, contractors, and service providers from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) health or care decisions made based on PetOS outputs; (e) your sharing of public links; or (f) your misrepresentation of identity or authority regarding any animal.

16. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYMBIOAI OS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF DATA, ANIMAL HEALTH, ANIMAL LIFE, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, AI OUTPUTS, OR ANY INFORMATION PROVIDED THROUGH THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

17. Disclaimer Of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT AI OUTPUTS, TRIAGE RESULTS, OR COST ESTIMATES WILL BE ACCURATE, COMPLETE, OR CURRENT.

18. Veterinary And Emergency Disclaimers

THIS SECTION CONTAINS CRITICAL DISCLAIMERS. PLEASE READ CAREFULLY.

NOT VETERINARY ADVICE. THE SERVICES ARE NOT INTENDED TO REPLACE PROFESSIONAL VETERINARY CARE. ALL INFORMATION, AI OUTPUTS, TRIAGE ASSESSMENTS, COST ESTIMATES, AND RECOMMENDATIONS ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

NO VCPR. USE OF THE SERVICES DOES NOT CREATE A VETERINARIAN-CLIENT-PATIENT RELATIONSHIP. SYMBIOAI OS LLC IS A TECHNOLOGY COMPANY, NOT A VETERINARY PRACTICE.

NOT A DIAGNOSTIC TOOL. THE SERVICES ARE NOT DIAGNOSTIC MEDICAL DEVICES. TERMS SUCH AS "TRIAGE," "ASSESSMENT," "CHECK," AND "GUIDANCE" REFER TO INFORMATIONAL DECISION SUPPORT, NOT CLINICAL DIAGNOSIS.

EMERGENCIES. THE SERVICES ARE NOT DESIGNED FOR EMERGENCIES. IF YOUR PET IS HAVING TROUBLE BREATHING, COLLAPSING, BLEEDING HEAVILY, HAVING SEIZURES, LOSING CONSCIOUSNESS, OR SHOWING SEVERE DISTRESS, CONTACT YOUR VETERINARIAN OR NEAREST EMERGENCY ANIMAL HOSPITAL IMMEDIATELY. DO NOT RELY ON PETOS TO ASSESS EMERGENCY SEVERITY.

19. Acceptable Use

In addition to Section 4, you will not use the Services to transmit malware, conduct security probing, spam other users, harass anyone, submit deliberately false health data, or facilitate animal fighting, abuse, or cruelty.

20. Governing Law And Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.

Any dispute arising out of these Terms or the Services shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Either party may seek injunctive relief in any court of competent jurisdiction for infringement of intellectual property rights.

These Terms do not include a mandatory arbitration provision.

21. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy and in-app supplemental notices (Medical Disclaimer, Data Sharing Notice, Commission Disclosure), constitute the entire agreement between you and PetOS regarding the Services.

Severability. If any provision is held invalid, the remaining provisions remain in effect.

Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Force Majeure. We are not liable for failure to perform due to causes beyond our reasonable control.

Survival. Sections 4, 5, 8, 15, 16, 17, and 18 survive termination.

Changes. We may update these Terms. Material changes will be notified at least thirty (30) days before the effective date where required. Continued use after the effective date constitutes acceptance, except where applicable law requires renewed consent.
